PURCHASE  AND  NON-DISCLOSURE  AGREEMENT-   Easy Levels LLC  is  solely  an  educator  providing  training  on  the  theory  of analyzing  financial  markets. Easy Levels’  services,  signals,  subscription  services,  and  all  products  are for  illustrative,  informational  and  educational  purposes  only.  By  signing  below,  you  acknowledge that  you  understand  this  mission.   Easy Levels LLC does  not  provide  trading  and  financial  advice.  Each  and every  trade  example  shown  by  Easy Levels LLC  is  hypothetical  and  subject  to  the  limitations  of  hypothetical results  as  previously  described  and  as  described  in  the  Terms  of  Use  and  Service  on  the Easy Levels LLC  Web  Site  and  incorporated  by  reference  herein.  

 

 The  copyright  in  all  materials  provided  on  Easy Levels LLC  web  sites  (“Sites”)  and  in  its  course  materials  is held  by  Easy Levels LLC  and none  of  the  material may  be  copied,  reproduced,  distributed,  republished,  downloaded,  uploaded,  displayed,  posted, transmitted  or  retransmitted  in  any  form  or  by  any  means,  including,  but  not  limited  to,  electronic, mechanical,  photocopying,  recording,  or  otherwise,  without  the  prior  written  permission  of  Easy Levels LLC.   Purchaser  of  the  Easy Levels LLC indicator  is  granted  a  non-exclusive   software  license to  use  the  software.  The  software  remains  the  sole  and  exclusive  property  of  Easy Levels LLC  and the  license  is  for  the  personal  use  of  the  purchaser.  Purchaser  is  permitted  to  use the  software  for  his  or  her  own  personal  trading  and  is  prohibited  from  using  it  to trade  any  other  account  without  the  express  written  permission  of  Easy Levels LLC.  The  license is  not  transferable,  and  the  purchaser  is  prohibited  from  cloning,  copying,  reverse engineering  or  modifying  the  software.  Purchaser  agrees  that  only  one  software license  is  included  per  purchase  of  the  software.  Additional  software  licenses  can  be purchased separately  at additional fees. The  software  is  offered  for  educational  purposes  only. 

 

 Since  each  person  using  the software  is  different,  results  among  various  purchasers  could  differ  wildly.  Each  decision  whether  to develop  and/  or  use  signals  that  emanate  from  the  software  is  solely  the responsibility  and  decision  of  the  purchaser  and  Purchaser  acknowledges  that Easy Levels LLC will  not  be  responsible  for  any  losses  resulting  from  the  purchaser’s  use  of  the software  or any other service  provided by Easy Levels LLC officers, owners  and employees. The  purchaser  acknowledges  that  the  risk  of  trading  futures,  options  of  futures,  forex, securities  and  options  on  securities  is  substantial  and  that  only  risk  capital  is  to  be used  for  trading.  Trading  is  not  suitable  for  all  individuals.  Past  performance  is  not  necessarily indicative  of  future  results.   Hypothetical  performance  results  have  many  inherent  limitations,  some  of  which  are  described below.  No  representation  is  being  made  that  any  account  will  or  is  likely  to  achieve  profits  or losses  similar  to  those  shown.  In  fact,  there  are  frequently  sharp  differences  between hypothetical  performance  results  and  the  actual  results  subsequently  achieved  by  any  particular trading  program.  You  agree  that  there  will  be  NO  REFUNDS,  NO  EXCHANGES,  and  NO  RETURNS  after  the purchase.  All  sales  are  final  and  there  are  no  refunds  in  whole  or  in  part.     You  agree  that  any  charges  as  described  below  are  valid  and  nonrefundable.  Payment  is  not contingent  on  any  type  of  performance  and  there  is  no  guarantee  as  to  the  performance.  There  is  a  risk  of  loss  in trading  futures,  commodities,  options  on  futures,  securities,  options  on  securities  and/or  FOREX and  that  risk  can  be  substantial  and  you  agree  to  accept  that  risk.   You  agree  that  all  testimonials  are  believed  to  be  true  based  on  representations  of  the persons  providing  the  testimonials,  but  facts  stated  in  testimonials  have  not  been  independently audited  or  verified. The  average  reader  should  not  necessarily  expect  the  same  or  similar  results. Easy Levels LLC  has  the  sole  and absolute  discretion  to  reject  any  purchase  with  or  without  cause and shall not  be  required  to provide  any  reason  for  such  a  rejection.   

 

 This  is  neither  a  solicitation  nor an  offer  to  buy  or  sell  commodity,  futures,  options,  securities,  ETF’s  ,  Forex  or  any  other instrument.  You  are  strictly  responsible  and  assume  full  liability  for  any  trades  that  you  place  or any  profits  or  losses  that  you  incur.  As  a  purchaser,  you  agree  and  understand  that  you  are receiving  valuable  proprietary  information  and  trade  secrets. Easy Levels LLC  products  and  services  are  to be  used  for  your  own  personal  use  only  and  are  not  to  be  retransmitted  or  shared  in  any  way.  If this  agreement  is  breached:  legal  action  may  be  taken  against  you.   You  further  agree  that  the  information  provided  to  you  is  for  your  own  personal  use  and  may  not be  used  in  any  commercial  capacity  unless  you  receive  specific  written  permission  from Easy Levels LLC.  If Easy Levels LLC  discovers  that  you  have  violated  this  provision,  your  access  to Easy Levels  will  be  cancelled  and  no refund  will  be  provided.  

 

ACCEPTANCE  OF  RISK  AND  RELEASE  OF  LIABILITY.  You  agree  not to  hold  Easy Levels LLC,  its  owners,  officers,  its  employees  personally  responsible  in  any  way and  indemnify  them  for  any  monetary  or  non-monetary  damages. You  are responsible  for  your  own  trading  actions.  Furthermore,  no  guarantee  is  made  that  any  of  the information,  materials,  services,  products,  websites,  signals,  methods,  analysis,  techniques  or anything  else  offered  by Easy Levels LLC will be  profitable  or  will  not  result  in  losses.   You  expressly  understand  and  agree  that  the  content,  products,  tools,  and  services  included  or obtained  via  or  as  part  of  the  company  sites  or  materials  are  provided  on  an  “as  is”   basis  and  without  representations  or  warranties  of  any  kind. Error  Corrections  and  Updates.   Easy Levels LLC  shall  have  no  responsibility  to  provide  updates,  error corrections,  bug  fixes  or  patches,  and Easy Levels LLC  sole  responsibility  in  the  event  the  Software is,  upon  notice  from  Subscriber,  to  request  Easy Levels LLC  to  use  commercially  reasonable efforts  to  cause  the  Software  to  operate. Subscriber’s  Sole  Remedy.  Easy Levels LLC  entire  liability  and  subscriber’s  exclusive  remedy  will  be,  at Easy Levels LLCs  option,  either  (a)  return  of  the  most  recently  paid  monthly  subscription  fee  or  (b)  use  of commercially  reasonable  efforts  to  repair  or  replace  the  software  upon  its  return  to  Easy Levels LLC.    This warranty  is  not  valid  unless  Easy Levels LLC  receives  written  notice from  subscriber  during  the  warranty period  of  a  failure  of  the  software  to  operate  in  accordance  with  the  education  provided.  Any replacement  software  will  be  warranted  for  the  remainder  of  the  original  warranty  period  or  30 days,  whichever  is  longer. Limitation  of  Liability.   Subscriber  acknowledges  and  agrees  that  the  consideration  which  Easy Levels LLC  is  charging  under  this agreement  does  not  include  any  consideration  for  assumption  by  Easy Levels LLC  of  the  risk  of  subscriber’s loss  of  profits,  trading  losses,  indirect,  special,  punitive,  consequential  or  incidental  damages which  may  arise  in  connection  with  subscriber’s  use  of  the  software. The  maximum  liability  of Easy Levels LLC, will  in  no  case  exceed  the  actual monthly  subscription  fee  most  recently  paid  to  Easy Levels LLC by  subscriber  for  the  software. All  disputes  shall  be  submitted  to  binding arbitration  through  the  American  Arbitration  Association.  The  decision  of  such  arbitrators  will  be final  and  not  subject  to  appeal. 

 

 This  Agreement  constitutes  the  entire  agreement  between  the  parties  hereto  and  cannot  be changed  or  terminated  except  by  a  written  agreement  signed  by  the  parties.   By  signing  this  Agreement  below:   •  You  agree  that  you  have  read,  understand  and  accept  all  the  terms  and  conditions  of  this agreement  and the User  Agreement License as  set  forth  on  the  Easy Levels LLC  Website  and incorporated by  reference  herein.   •  You authorize  us  to  charge  your  credit  card  or  your  PayPal  account  based  on  the  information you  provided.
